Resumo: Esta pesquisa analisou a contribuição das audiências de custódia no Tocantins para a efetivação do direito à proteção social de pessoas negras custodiadas, identificando dinâmicas institucionais e desafios relacionados ao racismo estrutural. O estudo caracterizou-se como descritivo, quali-quantitativo e interpretativo, realizando análise documental de dados do SISTAC e BNMP 3.0, além de doze entrevistas com magistrados. A análise crítica do discurso (Fairclough) e o referencial sobre contrato racial (Mills), dispositivo de racialidade (Carneiro), racismo da cegueira de cor (Bonilla-Silva) e criminalização da pobreza (Wacquant) fundamentaram a discussão. Os resultados evidenciaram que a audiência de custódia constitui uma "encruzilhada": espaço de tensão entre práticas que reproduzem o racismo institucional e possibilidades de transformação antirracistas. Identificou-se elevada subnotificação do quesito raça/cor, ausência de institucionalização do serviço de proteção social (APEC) e predominância de discursos judiciais marcados pela cegueira racial. A pesquisa revelou assimetria entre um sistema de punição institucionalizado e uma proteção social precarizada, dependente da voluntariedade dos atores. Como produto técnico, propôs-se um formulário para aprimorar a coleta de dados e subsidiar políticas de equidade racial. A pesquisa contribui para o debate sobre justiça racial e para a implementação do Plano Pena Justa, que reconhece o racismo institucional como elemento estruturante do sistema prisional brasileiro.
Abstract: The research project aims to analyze the social protection of black people held in custody hearings, in the context of structural and institutional racism in Tocantins, seeking to deepen the debate on racial justice and unequal access to social protection, contributing to the formulation of more effective and equitable public policies. The project is justified by the need to analyze how custody hearings, as a procedural instrument that aims to guarantee respect for the fundamental rights of those arrested in flagrante delicto. It can contribute to identify the need for access to public policies and promote the social inclusion of the black population, which, especially young black people and those from the outskirts of the city, find themselves in a situation of greater social vulnerability, which increases their exposure to violence and incarceration. The research aims to analyze the contribution of custody hearings in Tocantins to the realization of the right to social protection of black people in custody, identifying the institutional dynamics and challenges related to structural racism in this process, evaluating the effectiveness of custody hearings as a mechanism to guarantee access to social protection services and the interaction between race/color and other social vulnerabilities in accessing these services, in addition to proposing the creation of a form to improve the evaluation and monitoring of public social protection policy in relation to racism. The research will be descriptive, qualitative-quantitative and interpretative, conducting semi-structured interviews with social workers who work in custody hearings in Tocantins and also a documentary analysis, using secondary data from the Custody Hearing System (SISTAC) of the CNJ. The research is expected to provide a detailed overview of the situation of black people in custody in accessing social protection, revealing the difficulties and potential of custody hearings in this context, contributing to the deepening of the debate on racial justice and to the production of knowledge about inequalities in access to justice and social protection, with a focus on the black population.
