| metadata.dc.description.resumo: | Este artigo apresenta um estudo acerca das mudanças, na cadeia de custódia, decorrentes das atualizações e desdobramentos trazidos pela Lei 13.964/19, que alterou o Código de Processo Penal (CPP). Nele estão presentes o recorte legislativo sobre temas que se referem à cadeia de custódia: um estudo sobre a evolução da prova material até a recente mudança, reflexões sobre o tema a partir de estudo bibliográfico e análise de dados estatísticos do Tribunal de Justiça do Estado do Tocantins (TJTO) referente à anulação de processos por quebra da cadeia de custódia. O artigo também apresenta dados a respeito da adequação das Unidades de Polícia Científica e dos Institutos Gerais de Perícia frente às mudanças na cadeia de custódia trazidas pela lei 13.964/19, na região Norte do Brasil. Por fim, estão presentes desdobramentos processuais cabíveis em situações de não cumprimento dos termos da Lei 13.964/19. |
| Abstract: | This article presents a study about the changes in the chain of custody resulting from the updates and developments brought by Law 13,964/19, which changed the Code of Criminal Procedure (CPP). It presents the legislative section on themes that refer to the chain of custody: a study on the evolution of material evidence until the recent change, reflections on the theme from a bibliographic study and analysis of statistical data from the State Court of Justice Tocantins (TJTO) referring to the annulment of processes for breach of the chain of custody. The article also presents data on the adequacy of the Scientific Police Units and the General Institutes of Expertise in the face of changes in the chain of custody brought about by law 13,964/19, in the North of Brazil. Finally, there are procedural developments applicable in situations of non- compliance with the terms of Law 13,964/19. |
