metadata.dc.description.resumo: A presente dissertação, forjada em pesquisa bibliográfica, tem por objetivo analisar criticamente a Política de Enfrentamento ao Tráfico de Drogas no Brasil. Sabe-se que ao invés de resolver o problema, a política atual de enfrentamento ao tráfico de drogas, tem contribuído com o processo de marginalização de segmentos sociais, contra os quais recai à força do sistema penal. A quantidade de pessoas condenadas e presas por tráfico, seu perfil (pobres e com baixa escolaridade) e sua segregação social deixa transparecer que o modelo atual não consegue atingir o seu fim. Diante dessa constatação, a pesquisa propõe uma mudança de paradigma no tratamento do tráfico de drogas, que seja capaz de contrapor ao senso comum e reforçar a ideia de que a solução do problema não deve necessariamente passar pelo sistema penal. Pressupõe que as políticas públicas voltadas ao enfrentamento do tráfico de drogas precisam ser redimensionadas para que os gastos sejam mais concentrados em ações de prevenção e tratamento do vício. Paralelamente concluiu-se que o Poder Judiciário deve enfrentar tal problemática, a despeito da inércia do legislador. Assim, enquanto não sobrevenha alteração legislativa capaz de ajustar à realidade social o tratamento às drogas, ao usuário e ao traficante, incumbe ao operador do direito o trabalho de dar diretrizes interpretativas à legislação vigente, de modo a destacar o viés humanitário, focado na autonomia e na liberdade individual, no respeito à diversidade, na promoção de valores éticos e culturais, cuja postura minimizará as consequências da política repressiva e contribuirá com a diminuição do encarceramento por tráfico de drogas.
Abstract: The present dissertation, forged in a bibliographical research, seeks to critically analyze the drug policy in the country. It is known that far from solving the problem the current policy on drug trafficking has contributed to the marginalization of certain social the strength of the penal system. The number of prisoners, due to convictions for trafficking, and the profile of these segregated people (poor and poorly educated), shows that the current model can not reach its goal. Given this mosaic, this research sought to propose a paradigm shift in the treatment of trafficking capable of opposing common sense, reinforcing the idea that the solution of the problem should not necessarily pass through the criminal system and that policies aimed at drug treatment need to be scaled up so that spending is focused on programs for the prevention and treatment of addiction. At the same time it was concluded that the Judiciary should face such a problem, despite the inertia of the legislator. Thus, as long as there is no legislative change capable of adjusting the treatment of drugs, users and traffickers to social reality, it is incumbent upon the director's agent to give interpretative guidelines to current legislation, in order to highlight the humanitarian bias, focused on autonomy and individual freedom, respect for diversity, promotion of ethical and cultural values, whose position will minimize the consequences of repressive policy and contribute to a decrease in incarceration for trafficking
