metadata.dc.description.resumo: Este trabalho tem por finalidade reconhecer a dignidade animal dentro dos direitos ambientais humanos. Busca influenciar a edição de atos normativos, legislativos e políticas públicas para promoção da dignidade animal. Têm por objetivos esboçar o contexto histórico da relação entre seres humanos e animais desde os primórdios. Identificar o singelo afastamento do antropocentrismo puro rumo ao biocentrismo, notadamente a partir da expansão das normas de direito ambiental com a Conferência das Nações Unidas sobre o Meio Ambiente Humano de 1972 até a Agenda 2030. Demonstrar atividades práticas desenvolvidas no Estado do Tocantins, por meio deste trabalho, no contexto da dignidade animal. Criar o Sistema de Órbitas da Vida, pelo qual todas as formas de vida dependem de equilíbrio entre os cinco elementos fundamentais – ar, água, solo, fauna e flora – e o sexto elemento fundamental agregado, capaz de equilibrar ou desequilibrar o sistema, o ser humano. No cerne do estudo o enfoque é empírico, com base nas experiências e evidências do pesquisador, com base teórica, assentada em saberes jurídicos, filosóficos e sociológicos do direito natural, das leis da natureza, dos direitos humanos e direitos fundamentais. Possui natureza aplicada, edificando atividades práticas em prol da dignidade animal. Inicialmente, a pesquisa se desenvolveu por meio de observação de campo, com registro fotográfico para aferir o tratamento destinado a animais de grande porte, atestando o predomínio arraigado do utilitarismo. Adiante, procedeu se a uma análise documental preliminar da legislação nacional, estadual e municipal vigente ao tempo de início, em que foi possível constatar a inexistência de normas em favor da dignidade animal. A pesquisa teórica está centrada na consulta de obras e publicações científicas nacionais e internacionais de teses, dissertações, artigos, doutrinas, legislação internacional e leading-cases de direitos constitucional e ambiental, e, sobretudo, daquelas correntes percussoras da dignidade animal. Entremeio à pesquisa teórica houve participação ativa em atos do Poder Público que tivessem como pauta a dignidade animal, a exemplo de audiências e reuniões públicas, capacitações, integração junto à Ordem dos Advogados do Brasil no Tocantins e à Câmara de Vereadores de Palmas. A audiência pública foi fundamental para a aprovação do Código Estadual de Proteção aos Animais no Tocantins, sancionado em agosto de 2019. Foi elaborada e protocolada a minuta do Projeto de Lei n. 148/2019 para contemplar o Código de Dignidade e Bem-Estar Animal no município de Palmas-TO. Por resultados, foi possível concluir pela necessidade de descentralização das políticas públicas e conscientização social a nível municipal, sobretudo para execução direta das atividades direcionada às particularidades locais, dado o multiculturalismo. Concluiu-se que as cinco liberdades do animal da FAWC e a atribuição de um valor econômico ao bem estar animal são fundamentais para alcançar, efetivamente, a dignidade animal. Concluiu-se que há um direcionamento rumo ao biocentrismo durante as últimas cinco décadas, e que o meio ambiente ecologicamente equilibrado se torna cada dia mais uma prioridade mundial. Com estas constatações, alinhavado à história da humanidade e a relação de interdependência entre o homem e o meio ambiente, desenvolveu-se o que se atribuiu chamar de estágios de expansão do regime normativo de meio ambiente e o Sistema de Órbitas da Vida, uma teoria ainda em sua fase embrionária, apresentada neste trabalho, para continuidade em estudo posterior.
Abstract: This work aims to recognize animal dignity within human environmental rights, to influence the edition of normative, legislative and public politics to promote animal dignity. They aim to outline the historical context of the relationship between humans and animals since the beginning. Identify the simple departure from pure anthropocentrism towards biocentrism, notably from the expansion of the rules of environmental law with the United Nations Conference on the Human Environment of 1972 until the Agenda 2030. Demonstrate practical activities developed in the State of Tocantins, through of this work, in the context of animal dignity. Create the Life Orbit System, whereby all forms of life depend on balance between the five fundamental elements - air, water, soil, fauna and flora - and the sixth aggregated fundamental element, capable of balancing or unbalancing the system, the human being. At the heart of the study, the focus is empirical, based on the researcher's experiences and evidence, based on theory, based on legal, philosophical and sociological knowledge of natural law, laws of nature, human rights and fundamental rights. It has an applied nature, building practical activities in favor of animal dignity. Initially, the research was developed through field observation, with a photographic record to assess the treatment for large animals, attesting to the ingrained predominance of utilitarianism. Ahead, a preliminary documentary analysis of the national, state and municipal legislation in force at the time of initiation was carried out, in which it was possible to verify the lack of rules in favor of animal dignity. Theoretical research is centered on the consultation of national and international scientific works and publications of theses, dissertations, articles, doctrines, international legislation and leading-cases of constitutional and environmental rights, and, above all, of those currents that perpetuate animal dignity. In the midst of theoretical research, there was active participation in acts of the State that had animal dignity as an agenda, such as public hearings and meetings, training, integration with the Brazilian Lawyers Association in Tocantins and the City Council of Palmas. The public hearing was fundamental for the approval of the State Code for the Protection of Animals in Tocantins, sanctioned in August 2019. The Draft Bill no. 148/2019 to contemplate the Animal Dignity and Welfare Code in the municipality of Palmas-TO. By results, it was possible to conclude by the need for decentralization of public politics and social awareness at the municipal level, especially for the direct execution of activities directed to local particularities, given multiculturalism. It was concluded that the FAWC's five animal freedoms and the attribution of an economic value to animal welfare are fundamental to effectively achieve animal dignity. It was concluded that there is a direction towards biocentrism during the last five decades, and that the ecologically balanced environment is becoming more and more a world priority. With these findings, in line with the history of mankind and the interdependent relationship between man and the environment, what was called the expansion stages of the normative environment regime and the Life Orbit System, developed a theory still in its embryonic phase, presented in this work, for continuity in a later study
