Resumo: : O presente Relatório Técnico trata do problema emergente no artigo 16 da Lei nº. 11.340, de 7 de agosto de 2006, que só autoriza a mulher vítima de violência doméstica a se retratar ainda na fase policial, ou seja, até o recebimento da denúncia e em audiência perante o juiz de direito. Ocorre que as vítimas não detêm a informação sobre o momento de se retratar, seja por falta de informação jurídica advinda da Defensoria Pública ou por falta de acompanhamento de um advogado, como acontece, na grande maioria dos processos, quando a vítima comparece perante o juízo, para ser ouvida, a denúncia já foi recebida e ela quer, mas não pode pedir o arquivamento do processo. Entende-se, dessa forma, que a tutela do Estado não respeita a liberdade e a decisão da mulher. Além disso, entende-se que quando a lei não permite à vítima desistir de processar seu agressor, o Estado está submetendo essa mulher a uma nova violência que atinge a família. O problema de pesquisa para o qual se busca resposta surgiu da observação no contexto da prática profissional e, a motivação para investigar a temática, teve início em razão da minha atuação na Vara de Combate à Violência Doméstica e Familiar da cidade de Araguaína/TO, na condição de magistrada, há mais de nove anos, convivendo com as vítimas de violência doméstica que vivenciam o sofrimento de ter reconstituído os vínculos afetivos com o agressor e os laços familiares e não podem requerer o arquivamento do processo, por falta de previsão legal. Constatou-se, com a pesquisa, que há indícios de que tal procedimento fere a efetividade jurídica ao princípio constitucional de proteção à família, bem como, o fato de que essas mulheres não foram assistidas integralmente em todas as fases do processo e, por isso, deixaram escoar o prazo legal para pedir o encerramento do processo, isto é, de apresentar a renúncia à retração ofertada na ainda fase policial. Assim sendo, a causa do problema está na falta de informação jurídica e acompanhamento adequado das mulheres, e não se pode partir do pressuposto de que elas devam saber como funciona a justiça. Assim, a solução encontrada para o problema reside na necessidade de atuação mais efetiva da Defensoria Pública, instituição que promove a defesa da maioria das mulheres que perde o prazo de retratação, no sentido de, ainda na fase policial, informá-las sobre o limite temporal previsto para o exercício do direito em foco e de adotar as providências legais de acordo com a vontade da ofendida, nos termos dos artigos 27 e 28 da Lei n°. 11.340/2006. O levantamento de dados estatísticos, a partir de informações obtidas no sistema de processo digital do Tribunal de Justiça do Estado do Tocantins (TJ), mostra que o percentual de vítimas de violência doméstica que se retrataram não é substancial, mas existe, e independente desse quantitativo, trata-se do respeito às liberdades e, no âmbito da prestação jurisdicional, de minimizar os custos com processos com denúncias que extinguem pela não presença da denunciante. Foram elaborados gráficos sobre os dados estatítisticos com conclusões sobre a violência doméstica e familiar nas Comarcas de Araguaína, Gurupi e Palmas. A pesquisadora também é coordenadora da Meta 8 do Conselho Nacional de Justiça, que visa melhorar a prestação jurisdicional à mulheres vítimas de violência doméstica, bem como dar celeridade aos processos. Para cumprir a Meta 8 foram desenvolvidas uma série de ações juntos às comunidades e em escolas de Araguaína e região, como campanhas, palestras, oficinas, etc., e acompanhamento de uma equipe especializada e, também, dos servidores da Comarca, com unidade de apoio móvel. No Relatório Técnico apresenta o problema de pesquisa e as soluções encontradas para combatê-lo e ou minimizar os impactos, como também expõe cinco produtos desenvolvidos ao longo da pesquisa: 1) Carta de Recomendação ao Presidente do Tribunal de Justiça do Estado do Tocantins para melhorar o sistema E-proc, criando um link no sistema que forneça informações sobre o perfil socioeconômico, cultural e social da família em situação de violência; sem tais informações as decisões judiciais ficam prejudicadas, pois deixa-se de analisar possibilidades de encaminhamento dos envolvidos para programas específicos e tratamento ofertados pelo Estado (para garantir uma perspectiva de vida familiar com condições mínimas de dignidade humana); 2) Ações para o cumprimento da Meta 8 do CNJ, como campanhas, palestras e oficinas desenvolvidas com a temática da violência doméstica, com registro fotográfico de todas as etapas; 3) Proposta e recomendação de Lei Municipal à Câmara Municipal de Araguaína/TO para introdução de campanhas educativas permanentes nas escolas municipais com a temática violência contra a mulher e combate à cultura do machismo; 4) Minuta encaminhada à Defensoria Pública com recomendações para o atendimento, a orientação e a assistência jurídica integral à mulher em situação de violência, com ênfase nas fases processuais, visando minimizar os impactos da desinformação e, sobretudo, para não incorrer no impedimento do artigo 16 da Lei nº. 11.340/2006, quando for do interesse da ofendida em renunciar ao processo.
Abstract: T: This Technical Report addresses the problem emerging in article 16 of Law n°. 11.340, of August 7, 2006, which only authorizes women who are victims of domestic violence to retract themselves during the police phase, that is, until the receipt of the complaint and in a hearing before the judge of law. It happens that the victims do not have the information about the moment to retract, either due to the lack of legal information from the Public Defender's Office or the lack of accompaniment by a lawyer, as it happens in the vast majority of cases, when the victim appears before the court , to be heard, the complaint has already been received and she wants to, but she cannot ask for the case to be closed. Thus, it is understood that the protection of the State does not respect women's freedom and decision. In addition, it is understood that when the law does not allow the victim to give up on prosecuting his aggressor, the State is subjecting this woman to a new violence that affects the family. The research problem for which an answer is sought arose from observation in the context of professional practice, and the motivation to investigate the topic started because of my work in the Court to Combat Domestic and Family Violence in the city of Araguaína/TO, as a magistrate, for over nine years, living with victims of domestic violence who experience the suffering of having reconstituted the affective bonds with the aggressor and family ties and cannot request the filing of the process, due to lack of legal provision. It was found, with the research, that there are indications that such procedure hurts the legal effectiveness to the constitutional principle of protection to the family, as well as the fact that these women were not fully assisted in all phases of the process and, therefore, , allowed the legal deadline to request the closure of the process, that is, to present the waiver of the retraction offered in the still police phase. Therefore, the cause of the problem is the lack of legal information and adequate monitoring of women, and it cannot be assumed that they must know how justice works. Thus, the solution found for the problem lies in the need for more effective action by the Public Defender's Office, an institution that promotes the defense of the majority of women who miss the term of retraction, in the sense of, still in the police phase, informing them about the limit time foreseen for the exercise of the right in focus and to adopt the legal measures in accordance with the victim's will, under the terms of articles 27 and 28 of Law n°. 11.340/2006. The survey of statistical data, from information obtained in the digital process system of the Court of Justice of the State of Tocantins (TJ), shows that the percentage of victims of domestic violence that were portrayed is not substantial, but it exists, and regardless of this. quantitative, it is about respect for freedoms and, in the scope of the jurisdictional provision, to minimize the costs of processes with complaints that are extinguished by the non-presence of the complainant. Graphs were drawn up on statistical data with conclusions on domestic and family violence in the regions of Araguaína, Gurupi and Palmas. The researcher is also coordinator of Goal 8 of the National Council of Justice, which aims to improve the jurisdictional provision for women victims of domestic violence, as well as speeding up proceedings. In order to meet Goal 8, a series of actions were developed together with communities and schools in Araguaína and the region, such as campaigns, lectures, workshops, etc., and monitoring by a specialized team and also by the Comarca servers, with a training unit. mobile support. The Technical Report presents the research problem and the solutions found to combat it and or minimize the impacts, as well as exposing five products developed during the research: 1) Letter of Recommendation to the President of the Court of Justice of the State of Tocantins to improve the E-proc system, creating a link in the system that provides information on the socioeconomic, cultural and social profile of the family in situations of violence; without such information, judicial decisions are impaired, as it fails to analyze possibilities for referring those involved to specific programs and treatment offered by the State (to guarantee a perspective of family life with minimal conditions of human dignity); 2) Actions for the fulfillment of CNJ's Goal 8, such as campaigns, lectures and workshops developed with the theme of domestic violence, with a photographic record of all stages; 3) Proposal and recommendation of a Municipal Law to the Municipality of Araguaína/TO to introduce permanent educational campaigns in municipal schools with the theme of violence against women and combating the culture of machismo; 4) Draft sent to the Public Defender's Office with recommendations for assistance, guidance and full legal assistance to women in situations of violence, with emphasis on the procedural phases, aiming to minimize the impacts of disinformation and, above all, not to incur the impediment of the article 16 of Law n°. 11.340/2006, when it is in the offender's interest to renounce the process.
