| metadata.dc.description.resumo: | O presente trabalho insere-se na Linha de Pesquisa Currículos Específicos de Etapas e Modalidades de Educação, do Programa de Pós-Graduação Profissional de Educação da Universidade Federal do Tocantins. Tem como tema a articulação no conjunto de normas jurídicas internas vigentes necessárias ao processo efetivo de institucionalização do Sistema Municipal de Ensino/Educação de Araguaína/TO e entre estas normas municipais e o ordenamento jurídico nacional regulador do campo da educação. Seu objetivo geral é analisar a articulação no conjunto de normas jurídicas vigentes necessárias ao processo efetivo de institucionalização do Sistema Municipal de Ensino/Educação de Araguaína, derivadas de atos do Poder Legislativo e de atos do Poder Executivo, que incluem atos próprios e atos do Conselho Municipal de Educação, e entre estas normas municipais e o ordenamento jurídico nacional regulador do campo da educação. Enquanto método, a pesquisa fundamenta-se em pressupostos da teoria crítica, com natureza aplicada, abordagem qualitativa, cujos dados e informações foram coletados por meio de estudo de caso combinado com revisão de literatura e pesquisa documental. O estudo demonstra que a institucionalização do sistema municipal de ensino, por vezes, é compreendida erroneamente como sendo uma transferência de encargos educacionais da União e/ou do Estado aos Municípios. Porém, significa a descentralização da educação, implicando a constituição de elementos intencionalmente reunidos, abrangendo desde o planejamento até a avaliação de todas as instituições educacionais, sejam elas públicas ou privadas. Todavia, em se tratando especificamente do ordenamento jurídico do Sistema de Ensino no Município de Araguaína/TO, observa-se a existência de aspectos truncados na articulação entre as normas que traçam as diretrizes e bases da educação nacional, sejam do Poder Legislativo ou do Conselho Nacional de Educação. |
| Abstract: | The present work is part of the Research Curriculum Specific Lines of Stages and Modalities of Education of the Professional Postgraduate Program of Education of the Federal University of Tocantins. Its theme is the articulation in the set of existing internal legal norms necessary to the effective process of institutionalization of the Municipal Education/Education System of Araguaína/TO and between these municipal norms and the national legal system regulating the field of education. Its general objective is to analyze the articulation in the set of legal norms in force necessary to the effective process of institutionalization of the Municipal Education/Education System of Araguaína, derived from acts of the Legislative Power and acts of the Executive Power, which include own acts and acts of the Council Municipal Education, and between these municipal norms and the national legal system regulating the field of education. As a method, the research is based on assumptions of critical theory, with applied nature, qualitative approach, whose data and information were collected through a case study combined with literature review and documentary research. The study shows that the institutionalization of the municipal education system is sometimes mistakenly understood to be a transfer of educational charges from the Union and/or the State to the Municipalities. However, it means the decentralization of education, implying the constitution of elements intentionally gathered, ranging from the planning to the evaluation of all educational institutions, be they public or private. However, when dealing specifically with the legal system of the Education System in the Municipality of Araguaína/TO, it is observed the existence of truncated aspects in the articulation between the norms that outline the guidelines and bases of the national education, be they of the Legislative Power or of the Council National Education. |
