O Direito sistêmico como meio de ampliação do acesso a justiça pelo poder judiciário

Abstract

Systemic Law is a new subject in law that allows for joining other scientific sources and is structured by the set of applicable techniques for resolving legal conflicts, whether in the extra-procedural or endo-procedural phase. The main problem of the article seeks to understand the use of Systemic Law as a legal and possible means of conflict resolution by the Judiciary and how it participates in the third renewal wave of Mauro Cappelletti and Bryan Garth for the expansion of access to justice, when used by the judicial power. The methodological objective is exploratory, in view of obtaining preliminary and preparatory information, involving a bibliographic survey. It is concluded that Systemic Law is not synonymous with family constellation, as this is one of the techniques already practiced and Systemic Law is the set of principles and all the techniques that exist and will exist in the future. It finds theoretical support in the sense of Systemic Law to expand access to justice in the theory of renewal waves.
