metadata.dc.description.resumo: Esta Dissertação está inserida na linha ―instrumentos de jurisdição, acesso à justiça e direitos humanos‖ do Mestrado Profissional em Prestação Jurisdicional e Direitos Humanos da Universidade Federal do Tocantins – UFT, em parceria com a Escola de Magistratura do Estado do Tocantins – ESMAT. O objeto desta pesquisa é a mediação e tem como tema delimitado quanto à sua aplicação nos conflitos individuais trabalhistas por meio da atuação do Poder Judiciário via Comissões de Conciliação Prévia intersindicais para reduzir a prática do ajuizamento de ações, recursos e execuções trabalhistas. A pesquisa aborda a prática da mediação através do diálogo à luz da Teoria da Ação Comunicativa de Jürgen Habermas como forma de democratização do acesso à justiça. A partir da previsão contida na Resolução nº 125/2010 do Conselho Nacional de Justiça, analisa-se a viabilidade de uma reformulação das CCP´s para que o Poder Judiciário trabalhista utilize estas entidades como núcleos permanentes de mediação pré-processual. O problema que se apresenta nesta investigação é sobre a forma como a Comissão de Conciliação Prévia pode ser um instrumento efetivo de acesso à justiça no âmbito do direito individual do trabalho, e uma possível solução para reduzir a quantidade de ações trabalhistas individuais no Poder Judiciário. O principal objetivo da pesquisa é caracterizar a mediação como um instrumento alternativo efetivo para a solução dos conflitos trabalhistas individuais evidenciando a necessidade de reformulações nas Comissões de Conciliação Prévia intersindicais para servirem aos cidadãos como um dos meios de acesso à justiça. A pesquisa foi desenvolvida por meio de levantamentos bibliográficos e com o referencial teórico com obras sobre mediação e acesso à justiça na teoria do direito; afirmação dos direitos fundamentais sociais, especialmente os direitos trabalhistas que foram analisados diante do contexto histórico a partir do século XVIII e nas constituições brasileiras; sobre as características dos conflitos trabalhistas individuais e o surgimento do Poder Judiciário Trabalhista, e encontra suporte nas obras de Jürgen Habermas que permitem construir uma interação racional entre o agir comunicativo e a experiência da mediação na solução dos conflitos de interesses. Ao final faz-se a proposta de procedimentos para efetivar a mediação na Comissão de Conciliação Prévia para a solução de conflitos individuais trabalhistas.
Abstract: This thesis is embedded in the "instruments of jurisdiction, access to justice and human rights", of the Professional Interdisciplinary Master‘s degree of Services in Adjucation and Human Rights of Federal University of Tocantins – UFT, in a partnership with the Magistrates School of the State of Tocantins – ESMAT. The object of this research is the mediation and has as its delimited theme its application in individual labor conflicts through the acting of the judiciary via inter-union Prior Conciliation Committee to reduce the practice of filing actions, resources and labor executions. The research addresses the practice of mediation through dialogue in the light of Communicative Action Theory of Jürgen Habermas as a means of democratizing access to justice. From the provision contained in Resolution No. 125/2010 of the National Council of Justice, it is analyzed the viability of an overhaul of CCP's so that the labor Judiciary power uses these entities as permanent cores of pre-procedural mediation. The problem presented in this research is about how the Prior Conciliation Committee may be an effective means of access to justice under the individual labor law, and a possible solution to reduce the amount of individual labor disputes in the Judiciary. The main objective of the research is to characterize mediation as an effective alternative instrument for solving individual labor disputes highlighting the need to reformulate the inter-union Prior Conciliation Committees to serve citizens as a means of access to justice. The research was conducted through literature surveys and has the theoretical framework with works on mediation and access to justice in theory of law; affirmation of fundamental social rights, specially workers' rights that have been analyzed facing the historical context from the eighteenth century and in the Brazilian constitutions; on the characteristics of individual labor conflicts and the rise of the Labour Judiciary Power, and finds support in the work of Jürgen Habermas that allow you to build a rational interaction between communicative action and the experience of mediation in the settlement of conflicts of interests. At the end it is made the propositure of procedures to actualize the mediation in the Preliminary Conciliation Committee for the resolution of labor individual conflicts.
