dc.description.abstractThis paper presents a Case Study that presents the results of an experience with Therapeutic Justice in the resolution of a domestic violence case in the Criminal Court of Miracema do Tocantins/TO. The focus of the research was the treatment of an alcohol dependent aggressor, considering that the victim - wife and mother - did not want the husband and father of their three children arrested. The victim was assaulted only when her husband was under the influence of alcohol, as shown in the records narrating the threats and assault attempts. So, we started from two assumptions: 1) that there are situations in which the victim knocks on the doors of the Judiciary not to seek punishment for the aggressor, but to obtain a solution to his conflict and 2) that imprisonment has not eradicated or reduced the practice of violence against women. In view of this, the Central de Conciliation de Violência Doméstica (CeConViDa) referred the aggressor for treatment, considering the criteria adapted from US Drug Courts, which is a model for the treatment of people who commit crimes under the influence of drugs or abusive use of alcohol. A fundamental requirement is that the offender agrees to participate in an addiction treatment program. In this case, the aggressor was referred to the institution Alcoholics Anonymous (AA) with monitoring by a partner institution called Association for a Better Future (ALIAR). To compose the research works, we selected the processes related to domestic violence that were processed in the District Criminal Court of Miracema, in the period from 2013, 2015 to 2017 (excluding the year 2014 for the irrelevance of data), that is, before and after the implementation of CeConViDa, which resulted in a mapping of this type of crime in the district, complying with art. 8, item II, of the Maria da Penha Law, of integrated measures that provide for the promotion of studies, research and statistics on the problem. This stage of the research is anchored in the documentary analysis instruments - of processes arranged in the E-PROC. The case study sought to analyze the victim's intention when it sought the judiciary for help and the effects of treatment on the aggressor for the conciliation carried out between the parties mediated by CeConViDa. Therefore, it is a qualitative research that sought to identify the effects of conciliation and analyze the evidence to develop logical arguments for conciliation to evaluate cases involving domestic violence due to alcohol abuse. The objective of this work was to show that the Therapeutic Justice applied to domestic violence, in this specific case involving the abusive use of alcoholic beverages, can be an alternative to minimize the procedural costs in the courts and avoid imprisonment, as well as meeting the provisions of the Maria da Penha Law, art. 45, namely, that the judge can refer the aggressor to recovery and re-education programs. Thus, justice contributes to the realization of human rights of both women and men. The research allowed to verify that CeConViDa was little effective in the accompaniment of the works accomplished by the institutions to which the aggressor was sent, so that it can be affirmed that it was little effective in what the Therapeutic Justice demands. The fact is that the aggressor was referred for treatment by CeConViDa in 2015 and obtained satisfactory results - stopped drinking alcoholic beverages and, consequently, ceased domestic violence under the influence of alcohol, as shown by research conducted with ALIAR. The result of the research brought to light four products: 1) promulgation of Ordinances No. 03 and 04, creating the Domestic Violence Conciliation Center (CeConViDa); 2) the partnership of the Court of Justice with the ALIAR; 3) the dissemination of statistical data on domestic violence in the Criminal Court of Miracema do Tocantins; 4) the standardization of Therapeutic Justice procedures with the proposal of an Implementation Ordinance stating the criteria for admission of the aggressor to the treatment program.pt_BR

dc.description.resumo: O presente trabalho apresenta um Estudo de Caso que expõe os resultados de uma experiência com a Justiça Terapêutica na resolução de um caso de violência doméstica na Vara Criminal da Comarca de Miracema do Tocantins/TO. O foco da pesquisa foi o tratamento de um agressor dependente de álcool, considerando que a vítima – esposa e mãe – não queria a prisão do marido e pai dos seus três filhos. A vítima era agredida somente quando o marido estava sob efeito do álcool, como mostram os autos narrando as ameaças e as tentativas de agressão. Então, partiu-se de dois pressupostos 1) de que há situações em que a vítima bate às portas do Poder Judiciário não para buscar punição para o agressor, mas para obter uma solução para o seu conflito e 2) de que o encarceramento não tem erradicado ou minorado a prática da violência contra a mulher. Diante disso, a Central de Conciliação de Violência Doméstica (CeConViDa) encaminhou o agressor para tratamento, considerando os critérios adaptados das Drug Courts norte-americanas, que se constitui em modelagem para o tratamento de pessoas que cometem crimes sob a influência de drogas ou uso abusivo de álcool. Um requisito fundamental é que o agressor aceite participar de um programa de tratamento contra o vício. No caso, o agressor foi encaminhado para a instituição Alcoólicos Anônimos (AA) com acompanhamento por instituição parceira chamada Associação para um Futuro Melhor (ALIAR). Para compor os trabalhos de pesquisa foram selecionados os processos referentes a violência doméstica que tramitaram na Vara Criminal da Comarca de Miracema, no período de 2013, 2015 a 2017 (excluindo-se o ano de 2014 pela irrelevância dos dados), ou seja, antes e depois da implantação da CeConViDa, que resultou num mapeamento desse tipo de crime na comarca, atendendo ao art. 8°, inciso II, da Lei Maria da Penha, das medidas integradas que preveem a promoção de estudos, pesquisas e estatísticas sobre o problema. Essa etapa da pesquisa está ancorada nos instrumentais de análise documental – de processos dispostos no E-PROC. O Estudo de Caso buscou analisar a intenção da vítima quando procurou o poder judiciário pedindo ajuda e os efeitos do tratamento no agressor para a conciliação realizada entre as partes mediada pela CeConViDa. Portanto, trata-se de uma pesquisa de natureza qualitativa que procurou identificar os efeitos da conciliação e analisar as evidências para desenvolver argumentos lógicos em prol da conciliação para avaliação de casos que envolvam violência doméstica em decorrência do uso abusivo de álcool. O objetivo desse trabalho foi mostrar que a Justiça Terapêutica aplicada à violência doméstica, nesse caso específico envolvendo o uso abusivo de bebidas alcoólicas, pode ser uma alternativa para minimizar os custos processuais nos tribunais e evitar o encarceramento, bem como atende ao previsto na Lei Maria da Penha, art. 45, a saber, que o juiz pode encaminhar o agressor para programas de recuperação e reeducação. Assim, a justiça contribui para a efetivação dos Direitos Humanos tanto da mulher quanto do homem. A pesquisa permitiu aferir que a CeConViDa foi pouco efetiva no acompanhamento dos trabalhos realizados pelas instituições a que o agressor foi encaminhado, de forma que se pode afirmar que foi pouco efetiva naquilo que exige a Justiça Terapêutica. O fato é que o agressor foi encaminhado para tratamento pela CeConViDa em 2015 e obteve resultados satisfatórios – parou de ingerir bebidas alcoólicas e, por conseguinte, cessou a violência doméstica sob o efeito de álcool, conforme comprovam as pesquisas realizadas junto à ALIAR. O resultado da pesquisa trouxe à tona quatro produtos: 1) promulgação das Portarias nº. 03 e 04, criando a Central de Conciliação de Violência Doméstica (CeConViDa); 2) a parceira do Tribunal de Justiça com a ALIAR; 3) a divulgação dos dados estatísticos sobre a violência doméstica na Vara Criminal da Comarca de Miracema do Tocantins; 4) a normatização dos procedimentos da Justiça Terapêutica com a proposição de uma Portaria de Implantação expondo os critérios para a admissão do agressor no programa de tratamento.pt_BR
